Terms of Service
1. The agreement, and what Propy Market is
These Terms of Service are a contract between you and [OPERATOR LEGAL NAME], a [STATE OF ORGANISATION] company at [REGISTERED ADDRESS] ("Propy Market", "we", "us"). They cover propymarket.com (proppymarket.com redirects there), the app behind the login, every contest we run, the chat rooms and support. You accept them by creating an account or buying a ticket.
Propy Market is a contest of skill. A ticket is a simulated trading account with a virtual balance and a published rule set. You trade on it at real-market prices from our own price feed. Your result is ranked against the other entrants in the round (Counter) or measured against a reward table published before you entered (Journey, Career). Every rule is deterministic, identical for every entrant, published before entry, and contains no random element.
Nothing real is traded. We never buy or sell securities, futures, options or crypto for you; nothing you do on a simulated account is mirrored to any brokerage; and we hold no money for you. You buy a ticket, and if you win, we pay you a prize.
Propy Market is not a broker, an exchange, an investment adviser or a bank, and nothing on the service is advice to buy or sell any real asset. [COUNSEL]
The Contest Rules, the State Eligibility page, the Responsible Play page, the Simulated Trading Disclosure and the Privacy Policy are part of these terms. Every figure of a contest — a ticket price, a cap, a close time, a reward table — lives in the Contest Rules and on the round card; where these terms describe a figure differently, the Contest Rules govern that contest.
2. Who may use the service
You may open an account and enter paid contests only if all of the following are true.
You are 18 or older, or older where the state you live in sets a higher age for contests of skill. [COUNSEL]
You do not live in, and are not physically located in, a state where paid contests of skill are not permitted. The restricted states are listed on the State Eligibility page; the list may change, and the version published when you enter applies. Where the service is available outside the United States is stated on the same page. [COUNSEL]
You are not on a sanctions list. We screen every wallet address against sanctions lists, including OFAC's, at entry. An entry from a listed person or address is refused, and an account found to belong to a listed person is closed. Where the law forbids us from returning a payment to a listed person, we do not return it. [COUNSEL]
Employees and contractors of Propy Market, and members of their households, may play but cannot win prizes.
We determine where you are from your IP address and other signals. Hiding or misstating your location, with a VPN, a proxy or anything else, is a breach of these terms.
If we find that you entered a paid contest while ineligible, your entries are void and any prize is forfeited. An honest mistake about location gets the ticket fee back to the original payment source; a hidden location, a false age or a sanctions match does not. [COUNSEL]
3. Your account
One person, one account. Do not open a second account, share yours, or let anyone else trade on it.
An account is an e-mail address, a username and a password. Keep the password to yourself: everything done under your login counts as done by you until you tell us the account has been compromised.
Your username, your rankings and every finished simulated book (the trades and the equity curve of each ticket, once its round, run or Career has ended) are public. Pick a username you are happy to see on a leaderboard. Your e-mail address, payment details and identity documents are never public.
You can close your account at any time from the Account page or by writing to support@propymarket.com. Open tickets settle first, and a prize already earned is still paid under these terms.
We may suspend or close an account for a breach of these terms, for a legal or sanctions reason, or because it is being used for something other than playing the contests.
4. Tickets, payments and spend limits
A ticket costs the price published in the Contest Rules for the contest: a fixed price for a Counter round and for a Career entry, and your own stake within the published range for Journey. The price is shown before you confirm.
You pay by card, Apple Pay or Google Pay through Stripe, or in USDC or USDT through the MBW Connect wallet widget to the challenge's own address. We never see or store your card number; Stripe handles the payment and tells us only whether it succeeded. Every entry carries a wallet address — the address a crypto ticket was paid from, or the MBW Connect wallet linked to your account for a card ticket — and that is where a prize on it is paid.
A crypto payment counts when it is confirmed on-chain. A payment that confirms after entries have closed for that round, or arrives in the wrong asset or amount, buys no ticket and is refunded to the address it came from.
The ticket fee is the whole price. There is no deposit, no account balance and no stored value: every ticket is a separate purchase, and every prize is a separate payout.
Spend limits. You can set a daily and a weekly spend cap on the Account page; a platform default applies until you do. Before every re-buy you see your running spend. You can also set a cool-off period or exclude yourself from paid contests for the period you choose, and during that time you cannot buy a ticket. Each round carries a published cap on re-buys. We may apply our own limits to any account. If play is becoming a problem, help is available at [HELPLINE — COUNSEL].
5. Contests, rules and prices
Every contest has its section in the Contest Rules, published before entry, that sets the ticket price, the ticker or ticker list, the virtual balance, the leverage cap, the liquidation level, the timing, the caps on tickets and re-buys, the minimum number of entries and the prize or reward table. Buying a ticket accepts the rules shown at that moment for that contest. The summaries below say what each contest is; the Contest Rules carry every figure and govern if these summaries differ.
Counter. A round every half hour (Counter 30) or every hour (Counter 60) on one ticker we choose and announce when the round opens. Entries open when the round starts and close a published number of minutes before the bell. You may hold several tickets in one round up to the published cap, and if a ticket is liquidated you may buy another within the published re-buy cap. At the bell every ticket is ranked by its return in percent; a tie goes to the earlier entry. One person may hold more than one paying place.
Journey. One ticker from the day's list, your own stake as the ticket, 24 hours, a published leverage cap, and the ticket is out at the published drawdown. You may cash out at any time. We pay the reward ladder published in the Contest Rules on the return your run ends at. A run that ends at +10 % or more is a win, and the win milestones in the Contest Rules carry trophies and fixed cash rewards.
Career. A fixed entry, up to five tickers at a time from the universe, no time limit, a published leverage cap, and the ticket is out at the published drawdown. Every +5 % of profit earns a trophy; level 20, at +100 %, pays the cash reward and the special status published in the Contest Rules.
Prices. Every contest runs on our own price feed: dated prints from market-data providers, recorded by the platform. A contest settles on the prices we recorded, and the recorded prices are final for ranking and for every reward table. If the feed fails or carries a data error during a round, the round is void and every ticket is refunded (section 9).
The simulated account is a model. It fills orders at our recorded prices under the published rules; it does not claim that a real account would have filled at the same price, paid the same costs or been liquidated at the same point.
6. Prizes and payouts
Counter prizes come from the round's pool, which is the sum of every ticket fee paid in that round. First place receives 60 % of the pool, second 20 % and third 5 %; we keep 15 % as our service fee. When a house-guaranteed minimum pool was shown at entry, the prizes are calculated on at least that amount whatever the number of entries. Journey and Career rewards are paid by us from the published tables, not from a pool. [COUNSEL]
A prize is paid to the wallet address the entry was made with, the address shown on your ticket. Under $3,000 it is paid automatically when it is due: at settlement for a Counter round or a Journey run, and when the level is reached for a Career reward. $3,000 or more is held until you complete identity verification (section 7).
Payment is automatic. Where a round is under review for fair play (section 10), payouts for that round wait until the review ends. A prize is never paid twice for one entry.
Check the address before you enter. A payout sent to the address on the ticket discharges our obligation, and a transfer on a public blockchain cannot be recalled.
Trophies, levels and statuses have no cash value, apart from the fixed cash rewards named in the Contest Rules.
7. Identity verification for payouts of $3,000 or more
A payout of $3,000 or more is held until you complete a short identity verification. The check is run by MBW Connect, our wallet and identity partner: your documents go to them, and we receive the result. The threshold is per payout, not a running total. [COUNSEL]
We may ask for verification at a lower amount where the law requires it, and at any amount where a sanctions screen, a fraud signal or a legal request calls for it. [COUNSEL]
A held prize is held, not forfeited. If verification shows that the account does not belong to the person who entered, or that the person is ineligible under section 2, the prize is forfeited. If you simply do not complete it, we remind you; a prize that stays unclaimed for a long period is handled as the law on unclaimed property requires. [COUNSEL]
8. Taxes
Prizes may be taxable income. You are responsible for every tax on a prize you win, wherever you are taxed.
Where US tax reporting applies, we report prizes to the IRS. The current reporting threshold is $600 of prizes in a calendar year. [COUNSEL] Before paying a prize that takes you over that threshold we may ask for your taxpayer identification number on IRS Form W-9, or the equivalent form for a non-US person, and we may hold the payout until we have it. [COUNSEL]
We do not withhold tax from a prize unless the law requires it. [COUNSEL] Whether ticket fees can be set against prizes is a question for your tax adviser.
9. Refunds and voids
A ticket buys entry into a contest. The fee is not refunded because you lost, were liquidated, cashed out or changed your mind once the ticket was live.
A round or a ticket is void, and the fee refunded in full, when: a Counter round has fewer entries than the published minimum and no house-guaranteed pool was shown at entry; our price feed failed or carried a data error that affected the round; or we cancel a round for a technical fault or a legal reason before it settles.
A voided ticket is refunded to the original payment source: a card, Apple Pay or Google Pay payment back through Stripe to the method that paid, a crypto payment back to the sending address in the same asset. A card refund takes the time the card network needs, usually a few business days.
A void is decided from the platform's recorded data and announced on the service. A voided round has no winners and no prizes, whatever the simulated results showed.
If an error on our side is found after a round settled, we may correct the settlement within the dispute window (section 15) and pay any prize the rules required, to every entrant the correction reaches. A prize already paid to another entrant is not taken back because of a correction; a paid prize is recovered only under the fair-play rules (section 10). [COUNSEL]
10. Fair play and enforcement
Contests are won by skill at the screen. The following are forbidden: automation of any kind, including bots, scripts, API clients and auto-clickers; more than one account per person; collusion between entrants, including coordinated positions, shared tickets or any arrangement to split prizes; trading on inside or non-public information about a ticker; and exploiting a price error, a latency or a flaw in the platform instead of reporting it.
A breach voids your entries in the affected contests and forfeits the prizes from them; the fee of a breached ticket is not refunded, and in Counter it stays in the pool. [COUNSEL] A prize already paid on a breached entry is owed back to us. We may also suspend or close the account, refuse future entries, and correct the published results. [COUNSEL]
We detect breaches from the data the platform records: timing, order patterns, IP addresses, devices and the links between accounts. A decision rests on that data, and you can ask for a review under section 15.
Because usernames, rankings and every finished book are public, other entrants can see how a ticket was traded. Reports of a suspected breach go to support@propymarket.com.
11. Intellectual property
The service, its software, design, rules, contest formats, the names Propy Market, Counter, Journey and Career, and the content we publish belong to [OPERATOR LEGAL NAME] or its licensors. You may use the service to play. You may not copy, scrape, reverse-engineer or resell it, or build a competing service from it.
Market prices come from our data providers under licence. You may view them on the service; you may not extract, redistribute or republish them.
You own what you write in chat and the way you trade your tickets. By using the service you give us a worldwide, royalty-free licence to display your username, rankings, finished simulated books and chat messages on the service and to keep them in the public record of past contests. Finished books are public by design. What happens to them when an account is closed or deletion is requested is set out in the Privacy Policy. [COUNSEL]
If you believe something on the service infringes your copyright, write to support@propymarket.com with the details and we will act on it. [COUNSEL]
12. Chat conduct
Chat is for the contests and the markets. Do not post threats, harassment or hate; another person's private information; spam, advertising or referral links; anything that invites collusion, account sharing or prize splitting; claims of inside information; or content you have no right to share.
Chat is visible to everyone in the room and is kept for a limited period, as the Privacy Policy describes. Do not post anything you would not put on a public page.
We may remove a message, or mute or ban an account from chat, without notice. A repeated or serious breach of these rules is a breach of these terms.
Bill, the assistant in the challenge room, is software. It talks about the contest, the ticker and your simulated account; it never trades for you, it can be wrong, and nothing it says is advice about real trading or a promise about a result. Your conversation with Bill is kept for the same limited period as chat.
13. Disclaimers
The service is provided as it is and as it is available. We do not promise that it will be uninterrupted or error-free, or that every price print will arrive. For a feed failure or a data error, the remedy is the void and refund in section 9.
A simulated result forecasts nothing. A return on a simulated account says nothing about what real trading would have done, and nothing on the service is investment, tax or legal advice.
Market data is supplied by third parties and may be delayed, missing or wrong. We record what we receive, and the recorded print is what the contest runs on.
Stripe, MBW Connect and the blockchains that carry stablecoins are run by others. We are not responsible for their outages or fees, for a card issuer's refusal or for a slow on-chain confirmation, beyond refunding a ticket that was not issued (section 4).
To the extent the law allows, we disclaim every warranty not stated in these terms, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow this, so it may not apply to you. [COUNSEL]
14. Limitation of liability
You can lose what you paid for your tickets and nothing more. A simulated account cannot lose real money beyond the ticket you bought, and we hold no balance of yours.
To the extent the law allows, our total liability to you for all claims about the service in any twelve-month period is limited to the ticket fees you paid us in that period or $100, whichever is greater. [COUNSEL]
We are not liable for indirect, incidental, special or consequential loss, for lost profits, or for a prize from a contest that was voided or corrected under these terms. [COUNSEL]
Nothing in these terms limits a liability that the law does not allow to be limited, including liability for fraud. Some states do not allow some of these limits, so some of them may not apply to you. [COUNSEL]
15. Disputes
If you think a result, a void, a payout or an enforcement decision is wrong, write to support@propymarket.com within 7 days of the settlement of the contest concerned, with your username, the contest and the round, and what you think is wrong. We review it against the platform's recorded data: prices, orders, timings and entries. That recorded data decides, and we answer in writing. After the 7 days a settlement is final. [COUNSEL]
Before either of us takes a formal step, we both agree to try to settle the matter by writing to each other, and we answer within 30 days of your letter. [COUNSEL]
[COUNSEL — ARBITRATION PLACEHOLDER] Whether a dispute that is not settled this way goes to binding individual arbitration with a waiver of class actions, or to the courts of [STATE OF ORGANISATION], is a decision for counsel. This paragraph is completed before these terms come into force.
These terms are governed by the law of [STATE OF ORGANISATION], without regard to its conflict-of-law rules. [COUNSEL] A claim about the service must be brought within one year of the event it concerns. [COUNSEL]
16. Changes to these terms, and how to reach us
We may change these terms. For a material change we give at least 14 days' notice by e-mail and on the service before it takes effect. [COUNSEL] A Counter round or a Journey run you entered before the change settles under the terms and rules published when you entered. If you do not accept a change, close your account before it takes effect.
A change to a contest's rules (a price, a cap, a close time, a reward table) is made in the Contest Rules and applies only to tickets bought after it is published — except that a Career has no end, so a change can reach a running Career 30 days after it is published, as the Contest Rules set out; it never removes a trophy, a level, a status or a reward already earned, and you may end the Career before it takes effect. [COUNSEL]
If a court finds part of these terms unenforceable, the rest stays in force. These terms and the pages named in section 1 are the whole agreement between us about the service. We may transfer this agreement to a successor of the business; you may not transfer it.
